PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.64 of 2012 of Gopalapatnam Police Station, Visakhapatnam City, registered against the Petitioner/Accused No.1 herein for the offences punishable under Sections 395, 420, 382 or 412 of the Indian Penal Code, 1860 (for brevity ‘the I.P.C’). 2 2. Heard the learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, the petitioner is alleged to have committed offences punishable under Sections 395, 420, 382, or 412 of ‘the I.P.C.,’ in Crime No.64 of 2012 and Crime No.311 of 2010 of Gopalapatnam Police Station. The petitioner was arrested on execution of a P.T. warrant on 25.07.2025. He is a permanent resident of Thaarfil, Gous Nagar, near the Railway Station, Gulbarga, Karnataka State, and has a fixed place of abode. A combined charge sheet was filed in the above two cases and the same has been numbered as S.C.M.U.No.186 of 2025 on the file of the learned II Additional District and Sessions Judge, Visakhapatnam. There are altogether thirteen cases registered against the petitioner. The learned counsel for the petitioner submits that out of the thirteen cases, twelve cases have ended in acquittal and that this is the only case pending against the petitioner. 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused No.1, this Court is inclined to enlarge the Petitioner/Accused No.1 on bail. 6. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/Accused No.1 shall be enlarged on bail subject to him executing bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only), with two sureties for the like sum to the satisfaction of the learned II Additional Chief Metropolitan Magistrate, Visakhapatnam. ii. The Petitioner/Accused No.1 shall appear before the learned Trial Court on every adjournment without fail 3 and shall cooperate with the learned Trial Court in accordance with law. iii. The Petitioner/Accused No.1 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iv. The Petitioner/Accused No.1 shall not commit or indulge in commission of any offence in future. v. The Petitioner/Accused No.1 shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required. vi. The Petitioner/Accused No.1 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. _________________________ DR.
