Providing Water Supply for Construction in YSR Jagan Anna Colony layout in villages pertaining to Denduluru Mandal, Pedapadu Mandal, Pedavegi Mandal of Eluru District as arbitrary, illegal, amounts to non discharge of a legal obligation conferred on them and violative of Article 14, 19, 21 and 300-A of the Constitution of India, Consequentiallly direct the respondents herein to refund the enitre Deposit Amounts payable to the petitioner in respect of the thirty-five (35) works executed by the petitioner pursuant to the agreement bearing No. /2021-22 dated 05.05.2021, along with interest 24percentage per annum and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Pleased to direct the respondents herein to refund the enitre Deposit Amounts payable

Aggrieved by the non-payment of bill amounts to the petitioner for the various works executed under Agreement No. Nil/2021-22, dated 05.05.2021, the present writ petition has been filed. 2. Heard Sri Rachuri Lakshmikar, learned counsel for the petitioner and Ms. Naga Chandrika, learned Assistant Government Pleader for Panchayat Revenue. 3. Learned Assistant Government Pleader submitted that for release of deposited amount, the petitioner needs to make an application before appropriate authority. However, the petitioner has not been made such application as required under law. Until and then the petitioner make such an application, the grievance of the petitioner cannot be considered. 4
4. In reply, learned counsel for the petitioner sought liberty to make an application before the appropriate authority. 5. Taking into consideration the submission made by the learned Assistant Government Pleader, this Court is inclined to dispose of the writ petition by passing the following order:
(i) The petitioner is at liberty to make an appropriate application before the concerned authority. (ii) On receipt of such application, the authority concerned shall consider the same and pass appropriate orders thereon in accordance with law as expeditiously as possible. 6.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed. ____________________________
