The grievance of the petitioner in the present petition is that the respondent nos. 5 to 7 have encroached on a public land in front of his house and made constructions over the same and are also causing nuisance. In the aforesaid context, the petitioner prays that the encroachments of respondent nos. 5 to 7 be removed. It has been stated in the petition that the petitioner had approached the Officers of the Public Works Department as well as the Sub Divisional Magistrate but no action in accordance with law has yet been taken by the Sub Divisional Magistrate or any Officer of the Public Works Department. The petitioner has the remedy to approach the concerned Executive Magistrate under Section 152 of the Bharatiya Nagrik Suraksha Sanhita, 2023 (B.N.S.S) and in case, the petitioner files an application before the Executive Magistrate, the concerned Executive Magistrate is enjoined under the law to take cognizance and appropriate action in accordance with law as provided in Chapter XI of the Bharatiya Nagrik Suraksha Sanhita, 2023 (B.N.S.S).
