1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-
“a. Issue a Writ of Mandamus or any other Writ, Order or Direction directing the Respondents to correct the date of birth of the Petitioner in the Passing Certificate of the Delhi Secondary School Examination as issued by Respondent No. 1 vide Number dated W125/85029/0075 dated the 13th May 2025 and any other document issued by the Respondent No. 1 relying upon the said certificate, after recording his correct date of Birth i.e., 24 February 2009 as recorded in the Birth Certificate issued under the Registration of Births and Deaths This is a digitally signed order. Act and further to issue a fresh certificate to the Petitioner after making the aforementioned correction. …”
2. The brief facts of the case are that the petitioner was born on 24.02.2009 and was duly issued a birth certificate under the name “Ranveer Grover” by the relevant authorities. 3. Due to an inadvertent mistake at the time of admission to the respondent No. 2 school, the year of birth of the petitioner was wrongly recorded as 2010 instead of 2009 and the same was eventually carried forward in all the academic records of the petitioner including the Class-Xth certificate, wherein the date of birth of the petitioner is stated as 24.02.2010. 4. Several representations were made by the petitioner and his parents before the respondent No. 1/CBSE and respondent No. 2 school to rectify the inadvertent error on the basis of his public documents such as birth certificate, Aadhaar card, Passport, but to no avail. 5. Mr. Kumar, learned counsel for the respondent No. 1 has handed over a Counter Affidavit along with some documents which are taken on record. 6. My attention has been drawn to Annexure P-1 of the petition which is a birth certificate having date of registration as 19.03.2009 issued by the Municipal Corporation of Delhi, Government of National Capital Territory of Delhi under Section 17 of the Registration of Births and Deaths Act, 1969, showing the date of birth of the petitioner as
24.02.2009.
7. I have already in a similar matter of Nisha Ray v. Central Board Of Secondary Education & Anr. W.P.(C) 6554/2023, by relying on the
judgment of Hon’ble Supreme Court in the case of Jigya Yadav v. CBSE (2021) 7 SCC 535, reiterated the holding of the Hon’ble Apex This is a digitally signed order. Court that there can only be one Date of Birth and reconciliation of such discrepancies to make it consistent with other documents will cause no prejudice to respondents. Hence, the same must be allowed.
8. In the present case, the discrepancy in particulars i.e., the date of birth of the petitioner is apparent from a bare perusal of the Birth Certificate (Annexure P-1).

I am of the view that in case the petition is not allowed, the petitioner would be having inconsistent particulars i.e., discrepancy in his date of birth, one shown in public documents like birth certificate and Aadhar card, and the other reflected in his academic records like the Class-Xth certificate.
10. There is no controversy that the date of birth of the petitioner is 24.02.2009 which is not only supported by the birth certificate of the petitioner but also by government documents such as Aadhar Card and Passport.
11. In view of the above, the petition is allowed and the respondents shall make necessary changes and issue appropriate/ fresh certificates to the petitioner including the change in the Class-Xth mark sheet.
12. The records shall be modified accordingly and the original mark sheet of Class-Xth shall be surrendered by the petitioner at the time of issuance of the fresh/corrected mark sheet.
13. With these directions, the petition is allowed and disposed of.
