PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/Accused, seeking regular bail, in Crime No.236 of 2024 of Chittoor II Town Urban Police Station, Chittoor district. 2 2. A case has been registered against the petitioner herein for the offences punishable under Sections 131, 115(2) and 109(1) of the Bharatiya Nyaya Sanhita, 2023. 3. Case of the prosecution, in brief, is that, on 27.11.2024, at about 07.00 PM, the accused, who is working as a Police Constable, demanded his mother to give money for consuming alcohol. When she refused to give money, he kicked her on the left side of the abdomen forcibly and when she rose-up, the accused caught hold of her blouse and pushed her on the door frame of house. As a result, she sustained inner injuries and was shifted to hospital for treatment. While undergoing treatment, she succumbed to injuries. 4. Learned counsel for the petitioner submitted that the petitioner is under suspension and since 30.11.2024 he is in judicial custody. 5. On the other hand, learned Assistant Public Prosecutor opposed for grant of bail on the ground that the accused killed his mother. He submitted that the investigation is not yet completed and if the petitioner, who is a police constable, is released on bail he may hamper the investigation and tamper with the prosecution witnesses. 3 6. Heard. Perused the record. 7. A perusal of the material on record goes to show that the petitioner/accused, who is working as a Police Constable, is alleged to have killed his own mother by acting cruelly, when she refused to give money for consuming alcohol. Taking into consideration the nature and gravity of offence and that the investigation is pending, this Court is not inclined to grant bail to the petitioner/Accused. 8.
