Pursuant to order of this Court dated 26.05.2025, opposite party no. 1-Sri Pramod Kumar, the then Sub Divisional Magistrate, Bansi, Siddharth Nagar, who is presently posted as Additional District Magistrate (Finance and Revenue), Aligarh is present before the Court. 3. Sri Sanjay Kumar Om, learned counsel for opposite party no. 2 informed that opposite party no. 2-Madan Ram Pal, Assistant Executive Engineer, Jal Nigam (Rural), Siddharth Nagar has been superannuated on 31.07.2024, therefore, he is not present before the Court. 4. Sri M.P.S. Chauhan, learned counsel for opposite party no. 1 and Sri Sanjay Kumar Om, learned counsel for opposite party no. 2 have filed affidavits, which are taken on record. On the basis of affidavits, they submitted that order of Writ Court has been complied with and neither construction of water tank was made nor any demolition has been taken place, which is not disputed by learned counsel for the applicant. 5. Under such facts of the case, no further order is required to be passed. 6. File is consigned to the record. 7. Personal appearance of Sri Pramod Kumar, the then Sub Divisional Magistrate, Bansi, Siddharth Nagar, who is presently posted as Additional District Magistrate (Finance and Revenue), Aligarh is hereby exempted.
