Neutral Citation No. - 2025:AHC:81982 Court No. - 6 Case :- WRIT - A No. - 6817 of 2025 Petitioner :- Rajvir Singh Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Avanish Kumar Srivastava Counsel for Respondent :- C.S.C. Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri Avanish Kumar Srivastava, learned counsel for petitioner and Sri Brijesh Narayan, learned Standing Counsel for State.
2. Petitioner has served up to 62 years as Assistant Teacher, therefore, according to relevant Government Orders, he is not entitled for gratuity. So far as an argument of learned counsel for petitioner that gratuity shall be governed in terms of Payment of Gratuity Act 1972, has also no merit since this Court has in District Basic Education Officer Vs. Raja Ram Sharma and 2 others, 2025:AHC:49156 has held that payment of gratuity to teachers working in basic education be governed by the Government Orders and not by Act of Payment of Gratuity Act 1972. 3.Accordingly, claim of petitioner has no legal basis and accordingly writ petition is dismissed.
