The following prayers have been made in the instant writ petition:- "i) Issue a writ order or direction in the nature of Mandamus directing the respondent No.2/ Basic Shiksha Adhikari Moradabad to consider/decide the pending application of the petitioner and handover the possession of house for purpose of repairing and construction of old building situated at Katar Shaheed near about King Medical Hall Tehsil and District Moradabad. ii) Issue a writ order or direction in the nature of Mandamus directing the respondent No.2/ Basic Shiksha Adhikari to handover the key of locked house of the petitioner for repairing due to vacate the house not running school shifted other place in this time the house has been vacated so handover to the petitioner who is owner of the aforesaid house." 2. It is not disputed before us by Ms. Akanksha Sharma, appearing for B.S.A. that the School has been shifted to some other building. 3. In view of the said admitted position, learned counsel for the petitioner prays for withdrawal of the writ petition with liberty to file a fresh petition with proper reliefs. 4.
