1. This petition has been filed by the petitioner under Article 226 of the Constitution of India assailing the order dated 23.01.2024 passed by the learned District Education Officer, District Bastar, Jagdalpur (C.G.) by which the petitioner’s application for grant of compassionate appointment has been rejected as per Clause 6(A) which provides that if any family members is in Government MANISH YADAV Digitally signed by MANISH YADAV Date: 2025.11.19 11:39:46 +0530
2 service then other family member will not entitled to get compassionate appointment.
2. This issue raised in this petition is no more res judicata and it has been considered in Full Bench decision of this Court in case of State of Chhattisgarh & Others vs. Umesh Thakur in WA No. 236 of 2022 decided on 21.06.2023.
3. Therefore, the order dated 23.01.2024 passed by respondent No. 3 does no suffer from any perversity, illegality warranting interference by this Court. Accordingly, the writ petition sans merit dismissed. No order as to cost.
