ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... a Writ of Mandamus declaring the action of the respondents in not considering the petitioner's representation dated 28.12.2025, requesting immediate action against illegal trespass, damage and the unauthorised conduct of the MLA CUP Cricket Tournament in the petitioner's agricultural land by falsely announcing it as the venue through pamphlets, as illegal, arbitrary and violative of Articles 14 and 300-A of the Constitution of India and consequently direct the respondents to forthwith prevent and restrain any unauthorised conduct of the proposed MLA CUP Cricket Tournament or any other public gathering or sports activity in the petitioners private agricultural land admeasuring Ac.3.27 cents situated in Survey No.286/2B of Pedapalli Village, Yerravaram Revenue Village, Yelamanchili Mandal, Anakapalli District.”
2. Heard Sri Shaik Mohammed Ismail, learned counsel for the Petitioner, Sri P.Ajay Babu, learned Assistant Government Pleader for Home and learned Assistant Government Pleader for Revenue.

Learned counsel for the Petitioner would submit that, initially a case in Crime No.132 of 2023 on the file of Yelamanchili Rural Police Station, Anakapalli District has been registered against one Dasari Kumar and others and subsequently another case in Crime No.132 of 2025 on the file of Yelamanchili Rural Police Station, Anakapalli District has been registered against one Padala Nageswara Rao and five others, when they have trespassed into the subject land and caused mischief by damaging the crop.
Learned counsel would further submit that, even thereafter, Padala Nageswara Rao along with other villagers trespassed into the subject land and caused mischief by damaging the CCTV cameras and the fencing. It is further submitted that, resurvey has been conducted and boundary stones are also fixed at the subject land on 13.10.2025. Learned counsel would further

submit that the Petitioner has filed a suit in O.S.No.200 of 2023 on the file of the Court of Principal Junior Civil Judge, Yellamanchili seeking permanent injunction. It is submitted that recently on 28.12.2025 also they have given a complaint to the Police. Learned counsel would finally submit that, let there be a direction to the Police to consider the representation of the Petitioner and take appropriate course of action to protect the property of the Petitioner.

Learned Assistant Government Pleader for Home would submit that Crime Nos.132 of 2023 and 132 of 2025 have been registered against Dasari Kumar and others and Padala Nageswara Rao and others respectively. It is further submit that the Court may pass appropriate orders in the light of the latest representation presented by the Petitioner to the Police.
5. Learned Assistant Government Pleader for Revenue would submit that resurvey of the subject property has been conducted and boundaries were also fixed on 13.10.2025. It is further submitted that the Petitioner has been in possession and enjoyment of the said land, however, some rival group is claiming that it is a Government Poramboke land.
6. Considering the submissions made, since civil suit is pending before the competent Civil Court, the Writ Petition is disposed of. However, the Petitioner is at liberty to make an appropriate application before the concerned Civil Court in the light of the latest developments made and the learned Civil Judge may consider the same and take appropriate decision over the matter in order to protect the alleged possession of the Petitioner over the subject property. Respondent – Police are also directed to consider the

representation dated 28.12.2025 submitted by the Petitioner and take appropriate decision according to governing rules and law. There shall be no
order as to costs.
