This application is filed jointly on behalf of the Plaintiffs and the Defendant under Order XXIII Rule 3 read with Section 151 CPC for recording of the settlement between the parties. 2. This suit was instituted on behalf of the Plaintiffs inter alia seeking a decree of permanent injunction restraining the Defendant and all others acting on its behalf from using in any manner whatsoever, selling, offering for sale, advertising, directly or indirectly dealing in any products or services under the infringing marks or any other trade mark/logo or device which is identical or deceptively similar to and/or is a deceptive variant of, and/or includes Plaintiffs’ BHPC logo marks, This is a digitally signed order. During the pendency of the suit, Plaintiffs and Defendant have amicably resolved their inter se disputes and terms of settlement are incorporated in paragraph 6 of the application. Learned counsel for the Defendant submits that in consonance with the agreed terms, Defendant has paid the sum of Rs.1,00,000/- towards full and final settlement of all the claims, which stands paid and this fact is duly acknowledged by counsel for the Plaintiffs. 4. Court has perused the terms of settlement and finds the same to be lawful. Accordingly, this application is allowed and disposed of, recording the settlement between the parties. CS(COMM) 829/2025 and I.As. 19612/2026, 26018/2025 and 26025/2025 5. Suit is decreed in terms of settlement between Plaintiffs and Defendant. Needless to state, the settlement shall form a part of the decree and the terms thereof shall bind the parties thereto. 6. Registry is directed to draw up the decree sheet. 7. Suits stands disposed of along with pending applications. 8. Plaintiffs are held entitled to refund of entire Court fees in accordance with the Court Fees Act, 1870. 9.
