Neutral Citation No. - 2025:AHC:106287-DB Court No. - 29 Case :- WRIT - C No. - 15760 of 2025 Petitioner :- Umesh Kumar Verma Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Virendra Kumar Srivastava Counsel for Respondent :- Vineet Pandey,C.S.C.,Somya Chaturvedi,Suresh C. Dwivedi Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Vinod Diwakar,J. 1. Heard learned counsel for the petitioners, learned counsel for the respondents, and perused the record. 2. It is alleged in the instant writ petition that despite the fact that the contesting respondent nos. 6 and 7 are running a factory on the spot in violation of building and land use regulations, the respondent authority, namely the Agra Development Authority, has failed to take appropriate remedial action, even in the face of the directions issued by the Commissioner, Agra Division. 3. Shri Vineet Pandey, learned counsel appearing on behalf of the Agra Development Authority, submits that pursuant to a letter dated 09.06.2025 issued by the Joint Secretary of the Authority, notices have already been served upon the contesting respondents. It is further submitted that a ceiling order under Section 28 of the U.P. Urban Planning and Development Act, 1973, has also been passed against the unauthorized construction. 4. The said notice and the compliance action taken by the Authority have been placed on record. 5. In view of the above factual matrix and considering that the respondent authority has initiated remedial proceedings in accordance with law, we do not find it necessary to proceed further in the matter at this stage. 6. It is, however, observed that the proceedings initiated by the Agra Development Authority shall be carried out strictly in accordance with law and expeditiously, after affording due opportunity to all concerned parties. 7. With the aforesaid observation, the writ petition stands disposed of. Order Date :- 7.7.2025 Anil K. Sharma Digitally signed by :- ANIL KUMAR SHARMA High Court of Judicature at Allahabad
