Shukla,Vineet Kr. Sahu Hon'ble Rohit Ranjan Agarwal,J. On 2.11.2022 notice was issued to the appellant to engage another counsel. Office report dated 15.7.2025 indicates that notices issued to legal heirs of the sole appellant i.e. appellant nos. 1/2, 1/4, 1/5, 1/6 and 1/7 have returned back with postal remark that the aforesaid legal heirs of the sole appellant had already died, as far as appellant no. 1/1 and 1/3 are concerned, the notices have not returned back after service. In view of the said office report, notice upon appellant nos. 1/1 and 1/3 is deemed sufficient. On due consideration of the aforesaid, it is clear that legal heirs of the sole appellant i.e. appellant nos. 1/2, 1/4, 1/5, 1/6 and 1/7 had already died and there is no substitution application for substituting their legal heirs. In view of the said fact, second appeal is dismissed for want of prosecution. However, it is made clear that in case any cause of action survives and legal heirs of appellant approaches the Court they may file recall application for recalling of this order.
