PUBLIC PROSECUTOR The Court Made the Following Order: The instant petition under Section 528 of the BNSS has been filed by the petitioner herein/Accused No.1, seeking quashment of proceedings against him in C.C.No.483 of 2024 on the file of the learned Judicial Magistrate of First Class, Amadalavalasa. 2. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor for respondent No.1/State. 3. Learned counsel for the petitioner submits that the petitioner is working in the Army at Secunderabad and that it is very difficult for him to attend the Court at Srikakulam. Therefore, it is prayed that the petition may be disposed of by dispensing with the appearance of the petitioner 2 before the trial Court, while granting liberty to the petitioner to raise all such contentions before the trial Court in his defence. 4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. 5. Considering the submissions made, the criminal petition is disposed of and the petitioner is at liberty to raise the present contentions before the trial Court and the learned Judge may appreciate them and take appropriate decision over the matter in accordance with law. However, the presence of the petitioner herein before the trial Court is dispensed with, except on the specific dates as directed by the trial Court.
