The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondents to consider them and again engage on the post of Safai Karamcharies. 2. The petitioners worked prior to 2022 with Municipal Council, Bhiwani (‘MC’) through an outsourcing agency i.e. respondent No.5. MC, from time to time, renewed contract of the outsourcing agency. On account of change of the Contractor or other reasons, the petitioners could not get opportunity to work with MC. 3. Learned counsel for the petitioner submits that MC should re- engage them. Action of the respondent is violative of different policies framed by the respondent particularly Haryana Government Outsourcing Policy dated 06.04.2015 (Annexure P-3). MC had engaged the Outsourcing agency. They were disengaged in 2022. A period of three years has passed away. This Court cannot ask an outsourcing agency to engage the petitioners. They were never directly engaged by MC, thus they have no right against MC. They have remedy to approach Labour Court, however, this Court cannot direct the private entity to avail services of the petitioners. 5. In the backdrop, the present petition stands disposed of with liberty to the petitioners to avail remedies as permissible by law. The petitioners are also at liberty to pursue their representation before the Deputy Commissioner.
