1. The following reliefs have been claimed in the writ petition:
"A. Issue a writ, order or direction in the nature of Mandamus commanding and directing the respondents to provide all relevant documents pertaining to the property of Late Smt. Ram Rati Devi to the Petitioner. B. Direct the Respondents to decide the representation of the Petitioner dated 31.03.2021 and 21.12.2024 in accordance with law within a time- bound period. C. Direct the Respondents to consider mutation of the Petitioner's name over the property of Late Ram Rati Devi after proper verification of documents."
2. The petitioner has prayed for mutation of her name over the property left behind by her maternal grandmother on basis of alleged right of succession. 3. Shri Rajiv Gupta, learned Addl. Chief Standing Counsel has invited our attention towards a letter dated 10 August 2022 whereby SDM, Basgaon, Gorakhpur has submitted a report to District Magistrate, Gorakhpur in connection with the application of the petitioner. It is mentioned therein that Jagdish Narayan, maternal grandfather of the petitioner died forty five years back. At that time, her father was alive and the entire bhumidhari land was recorded in the name of Ishwar Datt. After death of Ishwar Datt, name of Prashidh Narayan was entered in the revenue records on basis of succession much before the consolidation. The petitioner has already been apprised of the said facts and also that in case succession was wrongly recorded in the revenue records, it would be open to the petitioner to take appropriate proceedings under Sections 32/38 of U.P. Revenue Code, 2006. He submits that in such circumstances, the prayers made in the writ petition for issuing direction to decide the representation would be a futile exercise. 4. The submission appears to have force. In case, the petitioner is challenging the correctness of the succession recorded in the revenue records, it is open to her to avail legal remedy as provided under law. No purpose would be served in directing the State respondents to decide the representations filed by the petitioner.
In case, she requires any document, she should obtain the same also by moving appropriate application. 5. With the aforesaid liberty reserved in favour of the petitioner, the writ petition stands disposed of. Order Date :- 8.7.2025 Mukesh Kr. (Ram Manohar Narayan Mishra,J.) (Manoj Kumar Gupta,J.)
