1. This first anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 267/2025 registered at Police Station - Ganj, District - Raipur (C.G.) for the offence punishable under Sections 296, 351 (2), 115 (2), 119 (1) & 3 (5) of Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS’). 2. The prosecution case is that on 24.09.2025 the complainant who runs a street food stall at Railway Station Road, Raipur lodged report in the concerned police station alleging that on 23.10.2025 at about 06.00 PM in- front of Gate No. 2 when he was closing his shop at that instance the present
2 applicant along with his friends came at the spot and demanded money for consumption of liquor. When complainant refused to give money at that instance applicant attacked the complainant and beaten him by way of hands. Complainant has lodged the report and on the basis of the complaint police has registered offence under Sec 296, 351 (2), 115 (2), 119 (1), 3 (5) of B. N.S., 2023 against the accused person. 3. Learned counsel for the applicant would submit that the applicant is innocent and has falsely been implicated in the crime in question. He further submits that the applicant and the complainant are involved in business of sale of street food and vegetables respectively and due to a trivial dispute, the complainant alleged that the applicant assaulted him. He submits that there is no material available against the applicant in the FIR and he is not having any criminal antecedent against him. There is only one criminal antecedent (bearing Crime No. 268/2023, P.S. Ganj, District - Raipur) against the applicant.
Hence, he prays for grant of anticipatory bail to the applicant on the ground of parity. 4. On the other hand, learned State counsel has opposed the prayer for grant of anticipatory bail and submits that the present applicant due to heated dispute has assaulted the complainant and caused severe injuries to him. Therefore, he is not entitled for grant of bail. 5. Learned counsel for the objector submits that the complainant and the applicant have settled their disputes and entered into compromise. 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the facts & circumstances of the case, submissions of learned counsel for the parties, nature of dispute and material available in case diary, the complainant and the applicant have settled their dispute amicably, as such, without further commenting anything on merits, this Court find it appropriate to grant anticipatory bail to the applicant. 3
