IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 1163 of 2025 ------ Sartha Gope @ Sartho Gope, aged about 22 years, son of Lakhindra Gope @ Lakhindo Gope @ Lakhindar Gope, resident of Vill-Muraberia, P.O.+P.S.-Bagdahari, Dist.-Jamtara … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : None For the State : None ------ Order No.02 Dated- 20.02.2025 No one turns up on behalf of either of the parties in-spite of repeated calls. Apprehending his arrest in connection with Jamtara Cyber Crime P.S. Case No.71 of 2024 instituted under Sections 111(2)(ii)/317(2)/318(4)/ 319(2)/336(3)/338/340(2)/3(5) of the B.N.S., 2023 and Sections 66(B)/66(C)/ 66(D) of the Information Technology Act, the petitioner has moved this Court for grant of privileges of anticipatory bail. Perusal of the record reveals that the allegation against the petitioner is that the petitioner was involved in cybercrime. It is further averred in the anticipatory bail application that the allegations against the petitioner are all false and only mobile phone was recovered from the place of occurrence, but there is no allegation of any money trail. It is also averred in the anticipatory bail application that there is no allegation against the petitioner of cheating any particular person. It is next averred in the anticipatory bail application that the petitioner has no criminal antecedent as has been mentioned in paragraph no. 14 of the anticipatory bail application. It is then contended in this anticipatory bail application that the co-accused person has already been given the privilege of anticipatory bail by this Court vide order dated 04.02.2025 in A.B.A. No.786 of 2025. It is also averred in the anticipatory bail application that the petitioner is ready and willing to abide by any terms and condition as imposed by this Court. Considering the aforesaid facts of the case, I am of the opinion that it is a fit case where the abovenamed petitioner be given the privilege of anticipatory bail. Hence, in the event of his arrest or surrender within a period of six weeks from the date of this order, he shall be released on bail on depositing cash security of Rs. 20,000/- and on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Cyber Crime, Jamtara, in connection with Jamtara Cyber Crime P.S. Case No.71 of 2024 with the condition that the petitioner will cooperate with the investigation of the case and appear before the Investigating Officer as and when noticed by him and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the pendency of the case subject to the conditions laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
