1. The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 441/2025, registered
2 at Police Station Khamtarai, District- Raipur (CG) for the offence punishable under Sections 74, 78(2), 331(3) of BNS, 2023 and Section 8 of POCSO Act, 2012. 2. The prosecutrix along with her father appeared through DLSA Raipur and raised an objection with regard to bail application of the applicant. 3. The prosecution story in brief, is that, the complainant has lodged report in the concerned police station that at the time of incident, the applicant has committed outrage of modesty of the victim at her house. 4. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The allegation made by the prosecution against the applicant is false and baseless because the applicant has not played any role in connection of this crime. The applicant is in jail since 17.05.2025 and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 5. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 6. I have heard learned counsel for the parties and perused the case diary. 3

Considering the facts & circumstances of the case, particularly the fact that the applicant outraged the modesty of the victim who is aged about 16 years at her house when her father was not present in the house, nature & gravity of the offence, material available in the case dairy, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
Accordingly, the bail application of applicant- Uday Bande involved in Crime No. 441/2025 under Sections 74, 78(2), 331(3) of BNS, 2023 and Secton 8 of POCSO Act, 2012 at Police Station-Khamtarai, District- Raipur, Chhattisgarh, is rejected. 8. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 9. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
