Notice to the respondents is not necessary as the matter is being disposed of, without going into the merits. 2. The unsuccessful plaintiffs in O.S. No.238 of 2017 on the file of the Court of Civil Judge (Senior Division), Chittoor preferred appeal in A.S. No.52 of 2025 on the file of the Court of District Judge, Chittoor and the same is pending. 3. The learned counsel for the petitioners, inter alia submits that along with the appeal, the petitioners/appellants filed I.A. No.61 of 2025 under Order XXXIX Rules 1 and 2 and Section 151 of the Code of Civil Procedure, 1908 seeking temporary injunction restraining the respondent Nos.1 to 4 from disbursing compensation amount to respondent Nos.5 and 6 in respect of Acs.3.00 in Survey No.3/2 of Ayyamvandla Palli Revenue Village. She submits that the contesting respondents filed counter affidavit in the I.A., in September 2025, and that so far the said I.A., has not been taken up for disposal. She submits that as per Order XXXIX Rule 3A of CPC, the learned appellate Court has to dispose of the I.A., within the time-frame; however the matter is being adjourned on one ground or the other. She submits that in the event, the compensation 3 amount in respect of the above said property is disbursed during the pendency of the said I.A., the petitioners/appellant would suffer serious prejudice and she accordingly seeks appropriate orders. 4. Considering the submissions made, the Civil Revision Petition is disposed of, providing that the learned District Judge, Chittoor shall make endeavour to dispose of I.A. No.61 of 2025 in A.S. No.52 of 2025 strictly in accordance with law, after giving due opportunity to the parties, as expeditiously as possible, at any rate, within a period of six (6) weeks from the date of receipt of a copy of this order.
