Learned counsel appearing on behalf of the petitioner submits that the only material available against the present petitioner is the statement of a co-accused. The other allegation is that the petitioner’s motorbike was used to transport the alleged contraband. But, the keys of the motorbikes were always with the petitioner.
Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He submits that there are criminal antecedents of the petitioner including cases of murder, grievous hurt and under the Arms Act. There are statements of local witnesses which state that the petitioner was acquainted with the accused who was arrested and was often seen roaming around on the same motorbike.
Considering the above, the other incriminating materials available in the case diary and the restriction contained in Section 37 of the
2 NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.
Accordingly, the application for anticipatory bail of the petitioner is rejected.
