Heard learned Counsel for the Petitioner and Respondent Nos.3 & 9 and the learned Assistant Public Prosecutor. 3 3. Learned Counsel for the Petitioner submits that the Petitioner/complainant would not appear before the learned Trial Court as his wife was ill health. Ironically, the same was not mentioned in the grounds filed in the revision. 4. Learned Counsel for Respondents submit that the revision case is devoid of merit, as the complainant himself remained absent before the learned Trial Court despite repeated opportunities, showing no genuine interest to pursue the matter. Learned Counsel for Respondents further states that the plea of illness was never raised in the grounds of revision, and the police, after thorough investigation, had already referred the matter as civil in nature. Hence, it is urged to dismiss the Criminal Revision Case. 5. The learned Trial Court mentioned in its order dated 25.01.2020 that the complainant was continuously absent without appearing before the court for submitting his submissions despite giving several directions and opportunities; the learned Trial Court felt that the complainant had no interest to proceed further. Eventually, the learned Trial Court was constrained to dismiss the criminal complaint for the absence of the complainant. 6. The case was referred as civil nature by the police after conducting thorough investigation. The complainant/Petitioner filed a protest petition before the learned Magistrate under section 190 read with 200 of 'the Cr.P.C.' The complainant was aged about 66 years at the time of filing of this revision case. This revision was filed in the year 2020. Nearly five years have lapsed. Several respondents are aged about more than 60 years at the time of filing of 4 this revision. It is not known how many of the respondents are alive. There are no merits in this case. 7. Accordingly, the Criminal Revision Case is dismissed. No order as to costs. As a sequel, interlocutory applications, if any pending, shall stand closed. _________________________ Dr. Y.
