PUBLIC PROSECUTOR The Court made the following: ORDER: Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.1, 2, 3, 5, 6, 8, 9 and 11 on bail in Crime No. 179 of 2021 of Pedakurapadi Police Station, Palnadu District, registered against the Petitioners/Accused Nos.1, 2, 3, 5, 6, 8, 9 and 11 herein for the , 2 offences punishable under Sections 294, 509, 506 and 306 read with 34 of the Indian Penal Code, 1860. 2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. As seen from the record, the wife of the de-facto complainant, Rani, was found hanging from the ceiling fan with her saree. Prior to that, on 11.11.2021 at about 9:00 p.m., all the accused had gone to the house of the de-facto complainant and abused him and his wife in filthy language, as the de-facto complainant had informed others about the illicit relationship between two persons in the village. The petitioners were arrested on 30.01.2025 and 3. have been in judicial custody for the past 30 days. So far, twenty-three witnesses have been examined. The material portion of the investigation is completed. 4. Considering the facts and circumstances of the case, gravity and nature of the allegations levelled against the Petitioners/Accused Nos.1, 2, 3, 5, 6, 8, 9 and 11, this Court is inclined to enlarge the Petitioners/Accused Nos.1, 2, 3, 5, 6, 8, 9 and 11 on bail with the following stringent conditions; The Petitioners/Accused Nos.1,2, 3, 5, 6, 8, 9 and 11 shall be enlarged on bail subject to they executing a bond for a sum of Rs.20,000/- (Rupees twenty thousand only), with two sureties each for the like sum each to the satisfaction of the learned I Additional Civil Judge (Junior Division), Sattenapalli. ii. The Petitioners/Accused Nos.1,2, 3, 5, 6, 8, 9 and 11 shall appear before the Station House Officer, Pedakurapadu Police Station, Palnadu District, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court. I. 3 iii. The Petitioners/Accused Nos.1, 2, 3, 5, 6, 8, 9 and 11 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. The Petitioner/Accused No.4 shall not commit or indulge in commission of any offence in future. The Petitioners/Accused Nos.l, 2, 3, 5, 6, 8, 9 and 11 shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required. The Petitioners/Accused Nos.l, 2, 3, 5, 6, 8, 9 and 11 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. The Petitioners/Accused Nos.l, 2, 3, 5, 6, 8, 9 and 11 shall surrender their passport, if any, to the investigating officer. If they claim that they do not have a passport, they shall submit an affidavit to that effect to the Investigating Officer. Accordingly, the Criminal Petition is allowed. iv. V. VI. VII. 5.
