Learned State counsel refers to para 1 of the h no counter filed as rebuttal and reads thus: “That the petitioner has not come to the Hon’ble Court with clean hands. He was not allowed to join his duties as he did not fulfill the conditions of the Appointment Letter date 17.09.2001 (Annexure P2) reproduced as under for ready reference of this Hon’ble Court: “That he has neither convicted for any crime by any Court nor any Criminal case is pending against him.” But however as per affidavit dated 22.09.2001 furnished by the petitioner and later on confirmed by the Senior Superintendent of Police, Faridkot FIR No.9 dated 22.09.1997 was registered against the petitioner in Police Station Jaitu and trial of the Criminal Case was pending in the Court of Additional Sessions Judge, Faridkot. Thus, the petitioner was not allowed to join his duties. Hence the petition is liable to be dismissed.” Disposed of reserving the petitioner with a liberty to get it revived in still subsists.
