The Petition coming on for hearing, upon perusing the Petition and the memorandum of grounds filed in support thereof and upon hearing the arguments of SRI SIVAPRASAD REDDY VENATI Advocate for the Petitioner,' and of PUBLIC PROSECUTOR, for the Respondent, the Court following made the , 2 Dr.YLR.J Crl.PNo.12141of2025 Dated 28.11.2025 ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No. 184 of 2025 of Chapadu Police Station, Y.S.R.Kadapa District, registered against the Petitioner/Accused No.1 herein for the offences punishable under Sections 303(2), 109, 132, 49 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’), Sections 20(1) (C) (ii) (iii) (iv) (vi) and (x) of A.P.Forest (Amendment) Act, 2016, Rule 3 of A.P.Sandal wood and Red Sanders wood transit Rules, 1969 and Section 3 of the Prevention of Damage to Public Property Act, 1984 (for brevity ‘the PDPP Act’) and Section 51 of Wild Life Protection Act, 1972. 2. Heard the learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. As seen from the record, the petitioner is running a timber depot, wherein he possessed 6 logs weighing about 29.500 kgs of Red Sanders wood. There are no adverse or similar criminal antecedents reported against the petitioner. The petitioner is aged about 52 years. He is a permanent resident of Nagavarampadu Colony, Nellore Road, Gudivada Town, Krishna District. He has got fixed abode. He was arrested on 27.10.2025 and has been in judicial custody for the past 32 days. So far 3 witnesses have been examined, all are material and official witnesses. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused No.1, this Court is inclined to enlarge the Petitioner/Accused No.1 on bail. 5. In the result, the Criminal Petition is allowed with the following stringent conditions; i. The Petitioner/Accused No.1 shall be enlarged on bail subject to him executing bond for a sum of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties for the like sum each to the satisfaction of the learned Judicial First Class Magistrate for Special Court of Trial Cases of Red Sanders Smuggling Offences, Tirupathi. ii. The Petitioner/Accused No.1 shall appear before the Station House Officer, on every Saturday in between 10:00 am and 05:00 pm, till filing of the charge sheet. ) \ \ iii. The Petitioner/Accused No.1 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iv. The Petitioner/Accused No.1 shall cooperate with the Investigating Officer in further investigation of the case and shall make himself available for interrogation by the Investigating Officer as and when required. vi.
