ORDER: Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023^ by the Petitioner /Accused No.2 for granting of pre-arrest bail in connection with Crime No.121 of 2025 of B.N.Kandriga Police Station, Tirupati District, registered for the alleged offence punishable under Sections 191(2), 191(3), 109(1) read with 190 of the Bharatiya Nyaya Sanhita, 2023^ , / 1 the BNSS ^ the BNS

2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. As seen from the record, it is the allegation of the prosecution that the Petitioner and other accused on 08.10.2025 came on a car and four motorcycles holding sticks, rods and knives. It is alleged that the Petitioner and other accused tried to hit the de-facto complainant with the car, but the de-facto complainant escaped. The Petitioner and other accused have attempted to attack the de-facto complainant with knives, rods and sticks. However, the de-facto complainant escaped from their clutches and lodged a report. 3. 4. Learned Assistant Public Prosecutor submits that wound certificate has not yet been received. Accused No.1 was arrested on 09.10.2025 and he was enlarged on bail by this Court in CrI.P.No. 11647/2025, after forty days in the judicial custody. This Court granted pre-arrest bail to Accused No. 10 in CrI.P.No. 11648 of 2025 on 19.11.2025, and to Accused No.9 in Crl.P.No.11737 of 2025, Accused No.14 in Crl.P.No.11738 of 2025, Accused No.3 in Crl.P.No.11739 of 2025, Accused No.12 in Crl.P.No.11742 of 2025, Accused No.13 in Crl.P.No.11749 of 2025, and Accused No.8 in CrI.P.No. 11753 of 2025 by a common order dated 21.11.2025. 5. It appears that there are land disputes between the Petitioners’ group and the de-facto complainant’s group. The police have advised both groups to settle the disputes in the presence of the Tahsildar of the concerned Mandal. The wife of Accused No.1 lodged a report on 21.10.2025 against the de-facto complainant and some other persons, that/boort was registered as a case in
3 Crime No. 124 of 2025 for the offences punishable under Sections 131, 329(4), 115(2), 351(2), 79 and 324(5) read with 3(5) of the BNS, and Sections 3(1 )(r), 3(1 )(s), and 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989..
Considering the facts and circumstances of the case, gravity and nature of the allegations levelled against the Petitioner/Accused No.2, this Court is inclined to grant pre-arrest bail to the Petitioner/Accused No.2. 6. 7. In the result, the Criminal Petition is allowed with the following conditions; In the event of arrest of the Petitioner/Accused No.2 he shall be enlarged on bail subject to his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only), with two sureties for the like sum each to the satisfaction of the arresting police officials; The Petitioner/Accused No.2 shall make himself available for investigation as and when required; The Petitioner/Accused No.2 shall not cause any threat, inducement or promise to the prosecution witnesses; The Petitioner/Accused No.2 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. The Petitioner/Accused No.2 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. The Petitioner/Accused No.2 shall surrender his passport, if any, to the investigating officer. If he claims that he does not have a passport, he shall submit affidavits to that effect to the Investigating Officer. I.
