The instant Criminal Petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the Petitioner/Accused No.4, seeking quashment of proceedings pending against her in C.C.No.506 of 2024 on the file of the learned II Additional Judicial Magistrate of First Class, Kadapa for the offences punishable under Sections 498-A r/w 34 of IPC and Sections 3 & 4 of Dowry Prohibition Act. 2.

I.A.No.1 of 2025 has been filed by the Respondent No.2 to accord permission to compound the matter in C.C.No.506 of 2024 on the file of the learned II Additional Judicial Magistrate of First Class, Kadapa for the offences punishable under Sections 498-A r/w 34 of IPC and Sections 3 & 4 of Dowry Prohibition Act. 3. I.A.No.2 of 2025 has been filed by the Respondent No.2 to record compromise and quash the proceedings pending against the Petitioners in C.C.No.506 of 2024 on the file of the learned II Additional Judicial Magistrate of First Class, Kadapa for the offences punishable under Sections 498-A r/w 34 of IPC and Sections 3 & 4 of Dowry Prohibition Act. 4. Heard Sri S.Siva Nagarjuna, learned Counsel representing Ms. P.Kireerti, learned counsel for the Petitioner, Ms. K.Sowmya, learned Counsel representing Sri Tenepalli Niranjan, learned Counsel for the Respondent No.2

and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing on behalf of the State. 5. Accused No. 4 and Respondent No.2 appeared before this Court and were identified by the learned Counsel for the Petitioner and the learned Counsel for the Respondent No.2. 6. The Respondent No.2 appeared before this Court and would submit that they have settled the matter amicably before the elders. She would further submit that she has received an amount of Rs.22,50,000/- from her husband towards her maintenance as full and final settlement. They have already taken divorce by mutual consent. The couple was blessed with a son, who is aged about six (6) years. The boy stays with the mother. She has represented that she has no objection for her husband to visit the child and share his love and affection towards the child. 7. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate Orders. 8. Considering the submissions made by the Respondent No.2, and in the light of the judgment of the Hon’ble Apex Court in Gian Singh vs. State of Punjab and another1, since there is an amicable settlement between the parties, the I.A.Nos.1 and 2 of 2025 are allowed.
Consequently, this Criminal Petition is allowed, quashing the proceedings pending against the Petitioner/Accused No. 4, in C.C.No.506 of 2024 on the file of the learned II Additional Judicial Magistrate of First Class, Kadapa for the offences
