Applicant has preferred this application under Section 482 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of anticipatory bail as he apprehends his arrest in connection with Crime No. 340/2020 registered at Police Station- Bhilai Nagar, District Durg (C.G.) for offence punishable under Sections 302, 34 of IPC. 2. Case of the prosecution, in brief, is that allegation against the applicant is that he along with other co-accused persons have committed murder of D. Manish by assaulting him. Report was lodged by B. Ashish who is stated to one of the eye-witness, however, he has not named applicant to be one of the assailant. Though the incident is of the year 2020, however, after Covid-19 petitioner did not return back to Chhattisgarh state and when he returned back to Chhattisgrh in the year 2025 it came to his knowledge that one permanent arrest warrant is issued against him. 3. Learned State counsel opposes the submission of learned counsel for applicant and would submit that applicant is also one of the assailant in causing assault to D. Manish which resulted in his death. He contended that one of the co-accused persons mentioned the name of applicant in his statement and also one of the witness B. Ramesh in his statement before the court has stated name of applicant as one of the assailant caused assault to deceased. 4. I have heard learned counsel for the respective parties and also perused the documents enclosed along with bail application. 5.
Considering the entirety of the facts and circumstances of the case, submission of learned counsel for the respective parties, nature of allegation and further considering that the applicant was absconding after the alleged commission of offence since last about five years, I do not find present to be a fit case to allow this anticipatory bail application. 6.
