1. By this writ petition filed under Article 226 of the Constitution of India the petitioners pray for a direction to the respondents to regularize the services of the petitioners and further grant annual increments as per the order dated 01.02.2012 (Annexure P-4).

Learned counsel for the petitioners submits that the petitioners
3 were initially appointed to the post of Shiksha Karmis Grade III in the year 2012 on probation of two years under the Nagar Panchayat, Baloda and after completion of their probation period, the respondents had neither extended the further period of probation nor regularized their services. He submits that the petitioners’ character reports were forwarded by the concerned Head Master to the Chief Municipal Officer, Nagar Panchayat Baloda for regularization but no action was taken. He next submits that as per the order dated 01.02.2012 (Annexure P-4) issued by the Panchayat and Rural Development, though the petitioners are entitled for annual increments after completion of their probation period yet they have not been granted the same, therefore, the petitioners have made representations to the respondent no.3 with regard to regularization of service and the same has not been considered till date. He further submits that for the time being, this petition may be disposed of with a direction to respondents to decide the representations filed by the petitioners in accordance with Order dated 01.02.2012.
3. Learned State Counsel submits that at this stage the petitioners may be directed to file a fresh detailed representation before the respondents 3 & 4 and on such representation being filed, the same shall be decided in accordance with law.

In view of the above submissions, the petitioners are directed to file a detailed representation afresh before respondent no.3 and 4 along with a copy of this writ petition and the documents annexed thereto within a period of 30 days and on such representation being filed, the concerned authority of respondents No.3 & 4 shall consider
4 and decide the same within a further period of 90 days from the date of receipt of the said representation and communicate the decision taken thereof to the petitioners immediately. If the petitioners are aggrieved by the decision taken by the said respondents, the petitioners shall have liberty to challenge the same before the appropriate Court in accordance with law.
5. With the above direction/observations, this writ petition stands finally disposed of.
