Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or direction preferably writ of mandamus declaring the action of the 4th respondent in not implementing the orders vide D.Dis.(B4)/5014/2022 dt.19-01-2019 issued by the Sub- Collector, Madanapalli, wherein allowing the petitioner's appeal for mutation of his name in the revenue record as in respect of the land in Sy.No.710/3 to an extent of Ac.1.58 Cents situated at Mudaramdoddi

Village, V.Kota Mandal of Chittoor Dist., is ex-facie illegal, arbitrary and violative of principles of natural justice and consequently direct the respondent 3 and 4 to update the petitioner's name in the revenue record for the subject land.

ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"….to issue a writ or direction preferably writ of mandamus declaring the action of the 4th respondent in not implementing the orders vide D.Dis.(B4)/5014/2022 dt.19-01-2019 issued by the Sub-Collector, Madanapalli, wherein allowing the petitioner's appeal for mutation of his name in the revenue record as in respect of the land in Sy.No.710/3 to an extent of Ac.1.58 Cents situated at Mudaramdoddi Village, V.Kota Mandal of Chittoor Dist., is ex-facie illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents 3 and 4 to update the petitioner's name in the revenue record for the subject land and pass such other orders…."
2. The petitioner herein filed an appeal under Section 5B of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short, ‘the Act’) before the 3rd respondent-Revenue Divisional Officer. The said appeal was allowed and the Revenue Divisional Officer has passed the following order:
"Therefore, the appeal petition is allowed and the entry made in PPB/TD for the land in Sy.No.710/3 extent Ac.1-58 cents granted in favour of 1st Respondent vide ROR-IB Khata No.668 of Mudaramdoddi village is hereby deleted. The Tahsildar, V.Kota shall cause necessary changes in all village accounts under proper attestation and take necessary action for issue of PPT/TDs to the appellant on submission of claim petition under section 4(1) of A.P. Rights in Land and Pattadar Passbooks Act, 1971 after causing necessary

enquiry and conduct of field inspection. The appeal petition is disposed of accordingly."
3. Now the present Writ Petition is filed for implementation of the
order dated 19.01.2019 in D.Dis.(B4)/5014/2022.
4. Despite lapse of three years, the respondents have not filed any counter.
5. Though the notice was received by the unofficial respondent No.5, has not chosen to make any appearance before this Court.
6. Therefore, the present Writ Petition is disposed of, directing the 4th respondent to pass appropriate orders on the application through Mee Seva, vide CTR202301232923 dated 23.01.2023 filed by the petitioner under Section 6A of the Act in accordance with law. It is needless to say that the said application shall be disposed of within a period of two months from the date of receipt of a copy of this order. There shall be no order as to costs.
As a sequel thereto, Interlocutory Applications pending, if any, shall stand closed.
