THE HONOURABLE SRI JUSTICE D.RAMESH
WRIT PETITION No.32411 of 2025
ORDER: This Writ Petition is filed seeking to direct the respondents to grant assignment in favour of the petitioner in respect of the land to an extent of Ac.3.83 cents in Sy.No.84/4 and 84/5 of Muthukuru Village, Peddapanjai Mandal, Chittoor District. 2. The learned counsel for the petitioner submits that originally the land to an extent of Ac.3.83 cents in Sy.No.84/4 and 84/5 of Muthukuru village, Peddapanjani Mandal, Chittoor District (herein after referred to as ‘subject land’) belongs to the Government and the same was in possession and enjoyment of the family members of the petitioner. While so, the petitioner has made a representation to Respondent No.2 stating that the subject land was in possession and enjoyment of his family members and hence, requested to assign the subject land in his favour under Ex-servicemen quota. Thereafter, Respondent No.4 vide Ref.A/61/2025, dated 05.02.2025 submitted a report and Respondent No.2 after considering the reports submitted by the respondent authorities issued proceedings in D.Dis.No.L3/e- 493483/2025, dated 11.08.2025 directing Respondent No.4 to take action for grant of patta over the subject land in favour of the petitioner by following the due procedure contemplated in BSO-15 and G.O.Ms.No.743 Revenue Department, dated 30.04.1963. To support his contention, learned counsel for

the petitioner has drawn the attention of this Court to the relevant paragraph of the said proceedings, which reads as follows:-
9. The Revenue Divisional Officer, Palamaner/the Tahsildar, Peddapanjani ware directed to place the proposals in District Level Assignment Review Committee as per G.O.Ms.No.250 Revenue(Assign.I) Department, dated 15.05.2018 for grant of assignment in favour of Sri K.Chandrasekhar, Hav, No.2616722A for assignment of available Government lands measuring Ac.3.83 in Sy.No.84/5, 84/5 in Muthukuru Village of Peddapanjani Mandal in terms of G.O.Ms.No.743 Revenue Department, dated 30.04.1963(serving soldier category) for agricultural purposes”. The learned counsel for the petitioner contends that Respondent Nos.3 and 4 are not proceeding further in pursuance of the said proceedings and they are not granting assignment in favour of the petitioner in respect of the subject land which is illegal and arbitrary. Aggrieved by the said action, the present Writ Petition is filed. 3.
Considering the submissions of the learned counsel for the petitioner and on perusal of the material available on record, Respondent Nos.3 and 4 are directed to consider the proceedings issued by Respondent No.2 vide D.Dis.No.L3/e-493483/2025, dated 11.08.2025 and place the proposals before the District Level Assignment Review Committee as and when it is convened, for grant of assignment in favour of the petitioner in respect of the subject land. 4. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. 5
Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed. _____________________ JUSTICE D.RAMESH
