D PADMAVATHI The Court made the following: 2 THE HONOURABLE SRI JUSTICE D.RAMESH CIVIL REVISION PETITION No.1787 of 2025 ORDER: The present revision is filed aggrieved by the orders dated 27.06.2025 passed by the Family Court-cum-VII Additional District Judge, West Godavari, Eluru in I.A.No.863 of 2025 in F.C.O.P.No.104 of 2022. 2. The respondent herein has filed I.A.No.863 of 2025 in F.C.O.P.No.104 of 2022 under Order XVIII Rules 3(4)(3) and Section 151 C.P.C. seeking for recording the evidence of the respondent therein through video conference as she is residing in Texas, USA. Hence, she is unable to come to India as she has been pursuing her Masters Degree in USA and prays to order for recording of evidence through video conference. The said application has been considered and allowed. Aggrieved by the same, the respondent therein has filed the present revision. 3. Learned counsel appearing for the petitioner has submitted that perusal of the affidavit filed along with I.A.No.863 of 2025 in F.C.O.P.No.104 of 2022 reveals that the respondent herein has not filed any documents to substantiate that she is pursuing 3 Masters Degree at USA except one special power of attorney dated 18.01.2024. Hence, the Court below ought not to have entertained such application since cross-examination is difficult through video conference. 4. Learned counsel appearing for the respondent has made her submissions that the respondent is pursuing her Masters Degree at USA and the petitioner is not able to place any material to show that the respondent is residing in India. 5. In the said circumstances, as per the Gazettee Notification, if one of the parties resides outside the country, they may be permitted to allow through video conference. Hence, there are no merits to interfere in the orders passed by the learned Court below. 6. Considering the submissions as contended by the learned counsel for the petitioner and also the query raised by the Court, the counsel is also not able to place any material to show that the respondent is residing in India. In the said circumstances, this Court is not inclined to interfere with the matter. 4 7. Accordingly, the Civil Revision Petition is dismissed. There shall be no order as to costs.
