Appeal (DB) No.334/2025 and Mr. Shiv Shankar Kumar, learned A.P.P on behalf of the State in both these cases. These appeals are directed against the order dated 23.01.2025 passed by learned Additional Sessions Judge-I, Latehar in B.P. Nos.445/2024 & 450/2024 in connection with Herhanj P.S. Case No.41/2024, whereby and wherein, the prayer for bail of the appellants have been rejected. The allegation reveals that there was an exchange of firing between the extremists and the police personnel and on search, several arms and ammunitions were recovered from a bush. It appears that the appellants are in custody since 27.11.2024. It further appears that so far as the appellant in Cr.Appeal (DB) No.175/2025 is concerned, he does not have any criminal antecedent, though the appellant in Cr.Appeal (DB) No.334/2025 has got five criminal antecedents. -2- It also appears that none of the police personnel have suffered any injury on account of exchange of firing between the extremists and the police personnel. Regard being had to the manner of implication of the appellants, we, while setting aside the order dated 23.01.2025 passed by the learned Additional Sessions Judge-I, Latehar in B.P. Nos.445/2024 & 450/2024 in connection with Herhanj P.S. Case No.41/2024, direct that the appellants, above named, be released on bail, on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Latehar, in connection with Herhanj P.S. Case No.41/2024.
