1. The present Revision Petition, filed under Section 25B(8) of the Delhi Rent Control Act, 1958, seeks to set-aside the Order dated 26.10.2024 passed by Ms. Neetu Sharma CCJ-CUM-ARC (Central), Tis Hazari Courts, Delhi [“learned ARC”] in the case, bearing RC- ARC No. 611/2023, titled as “Smt. Sneh Lata Vs. Subhash & Another”, whereby an Eviction Order came to be passed against the Petitioners.

Learned counsel appearing on behalf of the Petitioners, on instructions, submits that the Petitioners shall vacate and hand over peaceful and vacant possession of the subject premises to the Respondent within a period of six (06) months from today.

Learned counsel further undertakes, on instructions, that the Petitioners shall pay use and occupation charges at the rate of ₹2,500/- This is a digitally signed order. per month from today till the date on which vacant and peaceful possession of the premises is handed over to the Respondent.
4. It is further undertaken that the Petitioners shall file an affidavit of undertaking incorporating the aforesaid undertakings within a period of two (02) weeks from today.

Learned counsel appearing on behalf of the Respondent, on instructions, submits that, in view of the aforesaid undertakings, he has no objection if the present Revision Petition is disposed of in the above terms.
6. This Court is of the view that, considering that the parties are ad idem on the aforesaid arrangement, no useful purpose would be served by keeping the present Petition pending. The undertakings furnished on behalf of the Petitioners shall remain binding upon them.
7. The Registry is directed to ensure that the affidavit of undertaking is placed on record within the aforesaid period of two (02) weeks.
8. It is made clear that in the event the Petitioners fail to file the said affidavit within the stipulated period, the protection granted by this Order shall automatically stand vacated, and the Respondent shall be at liberty to proceed with the execution of the Eviction Order in accordance with law.
9. It is also made clear that the Petitioners shall, in any event, hand over vacant and peaceful possession of the subject premises to the Respondent on or before the expiry of six (06) months from today.
10. Accordingly, the present Revision Petition, along with all pending Application(s), stands disposed of in the aforesaid terms.
