This Writ Petition is filed under Article 226 of the Constitution of India by the Petitioners for the following relief: “..to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not conducting the survey for demarcation of the petitioners property with fixed boundaries to the petitioner's land of an extent of Ac. 1.0714 cents in Survey No. 154, situated at Peda Nagulavaram Village Markapuram Mandal Prakasam district by considering the Petitioner F-Line Application No FSNV012500807383 on 07.08.2025 is illegal arbitrary and violation of principals of natural justice and consequently direct the respondents to conduct the survey for demarcation of the petitioner property with fixed boundaries for the land an extent of kcA.QT/z cents in Survey No.154 situated at Peda Nagulapuram Village Markapuram Mandal Prakasam district by considering the Petitioner F-Line Application No FSNV012500807383 on 07.08.2025 and to pass…” 1. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 2. The learned counsel for the petitioner requested this Court, without touching the merits of the case, to issue a direction to the respondent authorities to consider the F-line application dated 07.08.2025 submitted by the petitioner seeking for conducting a survey and fixing the boundaries in respect of the subject property admeasuring for an extent ::3:: of Ac.1.07½ cents in S.y.No.154, situated at Peda Nagulavaram Village, Markapuram Mandal, Prakasam district. 3. The learned Government Pleader for Revenue appearing for the respondents readily agreed to consider the F-line application dated 07.08.2025 submitted by the Petitioner, if any pending with the authorities. 4. In view of the submission of the learned Government Pleader for Respondents, this Court need not decide the truth or otherwise of the allegations made in the petition. This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh1”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do no service to the cause of justice. As the learned counsel for the petitioner himself requested to issue a direction to consider the F-line application dated 07.08.2025 submitted by the Petitioner, this Court find no other alternative except to issue such direction. 5. In the result, the writ petition is disposed of, directing the respondents to consider the F-line application dated 07.08.2025 submitted by the Petitioner within a period of two (02) months from the date of receipt of a copy of this order by passing a speaking order after 12019 (8) SCALE 544 ::4:: providing an opportunity of hearing to the petitioner and other stake holders if any. No costs. 6. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
