This MCC has been filed for restoration of WPS No. 2029/2021 which was dismissed for want of prosecution by this Court on 17.10.2025. 2. Learned counsel for the applicant submits that after restoration of the case, he filed his Vakalatnama on 10.10.2025. Thereafter, since 14.10.2025, he has been unable to attend court proceedings due to illness, as supported by the medical certificate filed as Annexure A/3. He further submits that the matter was listed on 17.10.2025, the intimation of which was received through the HIFZURRAHMAN ANSARI Digitally signed by HIFZURRAHMAN ANSARI Date: 2025.11.20 14:43:02 +0530 2 cause list on the evening of 16.10.2025, the last working day before the Deepawali vacation. Owing to his medical condition, he could not appear, and although another advocate, Mr. Vipin Tiwari, was requested to appear in the matter, he too was unable to attend due to his own arrangements. Therefore, he prays that the application may be allowed. 3. For the reasons stated in the application, the same is allowed and the order dated 17.10.2025 passed in WPS No. 2029/2021 is recalled.
