APHC010117472021 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3209] THURSDAY, THE TWENTIETH DAY OF NOVEMBER TWO THOUSAND AND TWENTY FIVE PRESENT THE HONOURABLE SRI JUSTICE NINALA JAYASURYA CONTEMPT CASE No.603 of 2021 Between: Chinta Subbayamma, W/o.Sambaiah, Aged about 54 years, Occ. Agriculturist R/o.2-80/2, Boppudi, Chilakaluripet, Guntur District, and others. … Petitioners AND State of Andhra Pradesh, rep. by its Principal Secretary to Government, Revenue Department, Secretariat, Velagapudi, Amaravati, Guntur District, and others. … Respondents Counsel for the Petitioners : Mr.B.Balaiah Counsel for the Respondents: Mr.V.Maheswara Reddy Mr.G.L.Nageswara Rao The Court made the following ORDER: The learned counsel for the petitioners is not available. 2. Mr.G.L.Nageswara Rao, learned counsel for respondent No.4 and Mr.Navin Kumar, learned counsel representing Mr.V.Maheswara Reddy, learned counsel for respondent No.5 made submissions with reference to the averments made in the reply affidavits. 3. This Court, by an order dated 23.12.2020 in Writ Petition No.24878 of 2020, directed that the petitioners shall not be dispossessed from the 2 cc_603_2021 subject matter land in the writ petition without following due process of law. 4. In the present Contempt Case, it is inter alia alleged that though a notice was issued to the respondents to implement the orders dated 23.12.2020 in its true spirit and not to interfere with the petitioners’ peaceful possession and enjoyment, the respondents intentionally and deliberately registered the case against the petitioners vide F.I.R. No.4 of 2021. 5. In the reply affidavit filed by respondent No.4, it is inter alia stated that pursuant to the orders referred to above, notices were issued to the writ petitioners on 06.1.2021 calling upon them to attend before the Tahsildar, Chilakaluripet for verification of DKT Pattas, but the petitioners have refused to take the same. It is also stated that eviction notices under Section 7 of the A.P. Land Encroachment Act were issued to the petitioners through registered post on 27.7.2021. Though it appears that no further action is taken, on a due consideration of the matter, this Court is of the considered opinion that no case is made out to punish the respondents on the allegation of violation of the orders passed in the writ petition. It may also be relevant to note here that no rejoinder is filed to the reply affidavits filed by respondent Nos.4 and 5. 6. For the afore-stated reasons, the Contempt Case is dismissed. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ____________________ NINALA JAYASURYA,J November 20, 2025 vasu
