Petitioner has filed this writ petition, seeking following reliefs:- “10.1 That, this Hon’ble court may kindly be pleased to direct the respondent no. 2 decide the application filed by the petitioner within stipulated period of 60 days. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent no. 2 decide the application filed by the petitioner and grant the permission to the petitioner for selling his property bearing Khasra No. 629 Rakba 0.15 hectare situated at Village Thakurpur, Tahsil- Ambikapur, Distt. Surguja (C.G.) to private respondent no. 5. 10.3 That, any other relief which this Hon’ble Court deems fit and proper may also kindly be granted to the petitioner in the interest of justice along with cost of the petition.” 2. Learned counsel for petitioner submits that petitioner has submitted an application before respondent no. 2/Collector for seeking permission to sale the land allotted to him on patta. Collector has already registered the application and have sent it to SDO, Ambikapur District-Surguja for submitting his report, however till date report is not been submitted and application filed by petitioner seeking permission of respondent no. 2 for selling of his land is still pending consideration, therefore, direction be issued to respondent no. 2 to conclude the proceedings within specified time. 3. Learned counsel for State submits that after receipt of advance copy, he has sought instruction from concerned authority and the report on subsequent queries made by respondent no.2 is still awaited. He submits that as per his instructions the proceedings will be concluded at the earliest. 4. Heard learned counsel for respective parties and also perused the documents enclosed along with this writ petition. 5. On due consideration and submission made by counsel for respective parties, particularly submission made by counsel for State, that Collector/Respondent no. 2 has put further queries to SDO after 3 submission of his report which is still awaited, I find it appropriate to dispose of this writ petition at this stage, directing respondent no. 2/Collector to conclude proceedings in accordance with law, expeditiously, preferably within a further period of three months from the date of receipt of copy of this Order. 6. It is made clear that this court has not expressed any opinion on the merits of the claim of petitioner and it will be for respondent no. 2/Collector to take decision on its own merits, in accordance with law. 7.
