Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction more particularly one on the nature of Writ of Mandamus to declare the action of the 2nd respondent in issuing transfer orders, vide Rc.No.GS/WS Transfers/E3/DMHO/CTR/2024, dated 17.07.2025, wherein the petitioner was placed at S.No.66 and transferred from Mittapalem sachivalaym under Chandragiri PHC, Tirupathi District to Pedduru Sachivalayam, despite the petitioner's representation dt.08.07.2025 and contrary to clause 7 (xi) of the transfer guidelines issued under G.O.Ms.No.5 dated 12.06.2025 and as illegal, arbitrary, in violation of article 14 and 16 of the Constitution of India and consequently prayed to set aside the impugned transfer orders against the petitioner standing at Serial No.66 in Rc.No.GS/WS Transfers/E3/DMHO/CTR/2024, dated 17.07.2025, issued by the 2nd respondent considering the case of the Petitioner on spouse grounds and to pass such other order. The present Writ Petition is filed questioning the action of Respondent No.2 in issuing transfer orders vide Rc.No.GS/ WS/ Transfers/ E3/ DMHO/ CTR/ 2024, dated 17.07.2025 transferring the Petitioner from Mittapalem Sachivalayam under Chandragiri PHC to Pedduru Sachivalayam in Tirupati District despite representation dated 08.07.2025 made by the Petitioner, as illegal, arbitrary and contrary to Clause 7(xi) of the transfer guidelines issued vide G.O.Ms.No.5, dated
12.06.2025. 2. The facts leading to filing of the present Writ Petition are as follows;
The Petitioner was appointed and was working at Mittapalem Sachivalayam under Chandragiri PHC and she had completed 5 years of service at the said place. The husband of the Petitioner by name V. Michael is working as Controller of APSRTC at Tirumala Depot since
08.03.2017. As per the guidelines issued under G.O.Ms.No.5, Department of Grama Sachivalayams and Ward Sachivalayams, dated 12.06.2025, the Petitioner exercised her option at 5 places, which are closer to Tirupati to continue her family life with her husband. However, the Petitioner was transferred from Mittapalem Sachivalayam under

Chandragiri PHC to Pedduru Sachivalayam despite the representation made by the Petitioner on 08.07.2025. Questioning the same, the present Writ Petition is filed. 3. During pendency of the Writ Petition, it is stated by the learned counsel for the Petitioner that the Petitioner had underwent life threatening surgery and a Memo, dated 07.11.2025 is filed enclosing the medical reports. The Discharge Summary dated 15.11.2025 issued by Sri Padmavathi Multi Speciality Hospital, Tirupati filed along with the Memo shows that the Petitioner was advised to take bed rest for 3 months, should not give strain and to avoid long journeys. The learned counsel for the Petitioner seeks for reconsideration of transfer of the Petitioner on the basis of her present medical conditions. 4. Learned Assistant Government Pleader appearing for the Respondents submits that if the Petitioner submits a detailed representation along with the medical reports, the Respondent authorities will consider the same and pass appropriate orders. 5.
Considering the submissions made, the Writ Petition is disposed of with the following directions;
(i) The Petitioner shall submit a detailed representation to the
Respondent-authorities enclosing medical reports within a period of
two (2) weeks from the date of receipt of a copy of this order;

(ii) Respondent No.4 shall examine the representation and the
medical reports submitted by the Petitioner and consider the
posting at a place closer to the husband of the Petitioner so as to
lead her family life;
(iii) This exercise shall be completed within a period of three (3)
months thereon;
