The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the “BNSS”), seeking quashing of FIR No. 67/2022, registered at Police Station Bhalswa Dairy, for the offences punishable under Sections 363/366/376 of the Indian Penal Code, 1860 (hereinafter referred to as the “IPC”) and Section 6 of the Protection of Children from Sexual Offences Act, 2012 (hereinafter referred to as the “POCSO Act”), along with all consequential proceedings emanating therefrom, on the basis of the settlement arrived at between the parties.

and submits that the allegations are serious in nature, particularly in view of the offences under Sections 376 IPC and Section 6 of the POCSO Act.
6. The petitioner and Respondent No. 2 are present before this Court and have been duly identified by their respective learned counsel and the Investigating Officer concerned.
7. Briefly stated, the present FIR came to be registered pursuant to a complaint made by Respondent No. 2 regarding the disappearance of her daughter, who was subsequently traced and recovered. During the course of investigation, Sections 366/376 IPC and Section 6 of the POCSO Act were added. The petitioner was arrested in connection with the present case and was subsequently granted regular bail. The charge-sheet has since been filed and the trial is stated to be pending.

It is further the case of the petitioner that the petitioner and Respondent No. 3, the daughter of Respondent No. 2, had known each other prior to the registration of the FIR and had solemnized their marriage on 13.01.2022. The parties have thereafter been residing together as husband and wife and have been blessed with two children. During the pendency of the proceedings, the parties entered into a settlement/agreement dated 20.02.2025 and have resolved their disputes.

Learned counsel for the petitioner submits that the petitioner and Respondent No. 3 are residing together peacefully and are leading their matrimonial life along with their two minor children. It is further submitted that Respondent No. 2 does not wish to pursue the present proceedings any further and has no objection to the quashing of the FIR.
10. On a query made by this Court, Respondent No. 2, who has been duly identified by the Investigating Officer, states that she has no objection to the This is a digitally signed order. present FIR being quashed. She further states that her daughter, Respondent No. 3, is married to the petitioner and that the parties are residing together peacefully.

In view of the settlement arrived at between the parties, the fact that the petitioner and Respondent No. 3 are presently residing together as husband and wife and have two minor children, and the categorical statement of Respondent No. 2 that she has no objection to the quashing of the proceedings, continuation of the criminal proceedings would serve no useful purpose in the peculiar facts and circumstances of the present case.
12. Accordingly, FIR No. 67/2022, registered at Police Station Bhalswa Dairy, for the offences punishable under Sections 363/366/376 IPC and Section 6 of the POCSO Act, along with all consequential proceedings emanating therefrom, is hereby quashed.
13. The present petition, along with all pending application(s), if any, stands disposed of.
14. Copy of this order be communicated to the concerned learned Trial Court for information and necessary compliance.
