Jyothi Prasad, learned Counsel for the Writ Petitioner and Sri Md. Saleem, learned Standing Counsel for the Civil Supplies and Sri V. Satya Sai Kumar, learned Counsel for the Unofficial Respondent No.5. 2. Sri Md. Saleem, learned Standing Counsel for the Civil Supplies, has submitted the Written Instructions furnished by the District Civil Supplies Manager dated 11.11.2025. Copy of it is supplied to the learned Counsel for the Writ Petitioner as well as learned Counsel for the Respondent No.5 and the same is taken on record. The relevant portion of the Written Instruction is usefully extracted hereunder: “It is to submit that vide reference 11th cited, as per the Central Vigilance Commission guidelines in this regard on 21.04.2022, “if the bidder, who bid has been found to be the lowest evaluated bid withdraws or whose bid has been accepted, fails to sign the procurement contract as may be required, or fails to provide the security as may be required for the performance of the contract or otherwise withdraws from the procurement process, the procuring Entity shall re-tender the case.” In view of the above, the V.C & Managing Director, APSCSCL, Vijayawada issued instructions that the request of Adusumilli. Srinivas Rao cannot be considered as per the terms and conditions of the tender document as per CVC Guidelines and also to go for re-tenders for Vuyyuru MLs point for appointment of Stage-II Transport Contractor for 2025- 3 27. And further requested the Joint Collector & EOED., APSCSCL, Krishna to take necessary action in this matter and report compliance. Hence, as per the above clarification the procedure of re-tender is under process.” 3. The above extract would indicate that the Official Respondents intend to go for retendering for Vuyyuru MLs point for appointment of Stage-II Transport Contractor for the years 2025-2027. 4. In view of the above, it is submitted by the learned Counsel for the Official Respondents that the successful bid of the L1 bidder (Respondent No.5) is cancelled and that the Respondents intend to go for fresh tender process. It is also submitted that the retendering process is also under process. Since the Respondents have already withdrawn the earlier Tender Notification with an intention to issue a fresh tender, this Court is of the view that no further consideration is necessary in this Writ Petition. 5. Needless to state that the Writ Petitioner as well as the Respondent No.5 shall have the liberty to participate in the retendering process. 6. With these observations, this Writ Petition stands disposed of. No order as to costs. 7.
