(ORAL) Instant first petition has been filed under Section 438 of the Code of Criminal Procedure seeking anticipatory bail in FIR No.89 dated 15.05.2024 under Sections 467/420/120-B of IPC, 1860 registered at Police Station Central Sector-17, Chandigarh. Learned counsel for the U.T. on instructions from ASI, Ram Lubhaya submits that the petitioners were granted interim anticipatory bail vide order dated 07.06.2024 passed by a co-ordinate Bench of this Court. However, thereafter petitioner Nos.1, 2 and 4 did not join the investigation and petition qua them has been dismissed and the same remains alive qua petitioner No.3 only. He further submits that on the last date of hearing, last opportunity was granted to petitioner No.3 to join the investigation but he has also not joined the same. There is no representation on behalf of petitioner No.3. From the perusal of the file it reveals that for the last two consecutive dates, there is no representation on behalf of petitioner No.3. Even today, position is the same. Present petition stands dismissed.
