The applicant has preferred this application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Bail, apprehending his arrest in connection with Crime No. 193/2025, registered at Police Station – Chhuriya, District – Rajnandgaon (C.G.) for the alleged commission of offence punishable under Sections 310 (2) of the Bhartiya Nyaya Sanhita, 2023.

The prosecution’s case in brief is such that, complainant, namely Tanaji Venkat Jyadav, who is engaged in the business of pig rearing in partnership with his nephew Hanumant, stated that on 07.08.2025, at around 01:00 PM, he had loaded 50 pigs valued at approximately 2,25,000/- in his Bolero ₹ Pickup vehicle bearing registration number MH 55 C 0193. After loading the
2 pigs, the driver Ishwar Shinde, along with his nephew Lahu Jadhay and Hanumant Gangapur, was sent with the intention of delivering the said pigs to one Ranjeet Seth of Bilaspur. It is further alleged that on 08.08.2025, at about 02:00 AM, near Kamala Agro Industry on the main road from Chichola to Dongargarh, 7-8 unknown persons, travelling in an unidentified Scorpio vehicle, allegedly intercepted the said Bolero Pickup and forcibly took away 50 pigs. It is also alleged that the said unknown persons snatched and took away three mobile phones belonging to the driver and his companions. Thereafter, this fact was reported by the informant/complainant to the police authorities and on the aforesaid written complaint, the aforesaid FIR was registered against the accused/applicant herein for the aforesaid offence.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He submits that the applicant have been impleaded in the FIR only on the basis of the memorandum statement of the co-accused persons and there is no mention of the present applicant in the FIR. He further contended that there is delay of 04 days in lodging the FIR and no specific averment has been raised against the applicant. Therefore, he prays for grant of anticipatory bail to the applicant.
4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the seizure of articles have been made from the possession of present applicant. He further contended that the FIR has been registered against the applicant after due enquiry and based on the statement of the co-accused. He submits that the investigation is still going on and charge-sheet has not been filed, the offence is prima facie made out against the applicant. Hence, he is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the nature and gravity of the offence and material on record in the case diary, and the facts and circumstances of the case and the
3 submission of the counsel for the parties particularly, the State Counsel that the seizure has been made from the present applicant and the applicant is a resident of Maharashtra, therefore, I am not inclined to grant bail to the applicant.

Accordingly, the bail application of the applicant – Dinesh Manikpuri, involved in Crime No. 193/2025, registered at Police Station – Chhuriya, District – Rajnandgaon, (C.G.) for the alleged commission of offence punishable under Sections 310 (2) of the Bhartiya Nyaya Sanhita, 2023, stands rejected.
