1. In the instant petition, petitoner is seeking direction upon respondents 3 and 4 to consider and decide the application of the petitioner with further direction to respondent No. 5 to demarcate the land of the petitioner.

It is stated that the petitioner along with other shareholders was joint owner of property/land measuring 11 Marlas falling under Survey No. 706/26 situated at village Regipora Kupwara, wherein the petitoner was entitled for the share of 03 Marlas of land. It is stated that the shareholders namely Ab. Samad and Dr. Gh. Mohd approached the Court of Sub Judge, Kupwara and after compromise in a civil suit with the deceased father, the decree was passed merely for 08 Marlas of land out of 11 Marlas, mutated in their names. It is stated that the petitioner has approached Deputy Commissioner concerned on 02.12.2023, thereby seeking cancellation of license of SB Hospital for which the construction has been raised on the land belonging to the petitioner. Learned counsel for the petitioner states that the petitioner would feel satisfied if the writ petition is disposed of at this stage with a direction to respondents 3 and 4 to consider and decide the application filed by the petitioner within a reasonable time. Learned counsel for the respondents is not averse to the proposition made by learned counsel for the petitioner.
4. In view of above, the instant writ petition is disposed of with a direction to respondents 3 and 4 to consider and decide the application of the petitioner within a period of one month from the date of passing of this
order.
