This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue any writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents in placing the land owned by me in Sy.No.5/3, 13/1,13/2, 12/1,12/2,12/3 to an extent of to an extent of Ac. 5.251/2 cents in a prohibitoryAc.562 1/2 cents. list under the Registration Act is illegal to declare the action of the respondents, the lands owned by me in Sy. Nos. 5/3, 13/1,2, 12/1,2,3 as a DKT pattas though the said lands were purchased by way of Registered sale deeds as illegal and arbitrary and consequently, direct the respondents delete the lands in Sy. Nos. 5/3, 13/1,2, 12/1,2,3 from the purview of the prohibitory list under section 22A of the Registration Act and to pass…” 2. Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for the respondents. 3. The present Writ Petition is filed, aggrieved by the action of the respondent authorities in placing the land owned by the petitioner in Sy.Nos.5/3, 13/1, 13/2, 12/1, 12/2, and 12/3, admeasuring to an extent of Ac. 562 ½, to an extent of Ac.5.25½ cents, in the prohibitory list under Section 22-A of the Registration Act, 1908. The petitioner seeks a declaration that the action of the respondents in including the petitioner’s lands in the prohibited property list and treating the said lands as D.K.T. patta lands, despite the petitioner having purchased the same under valid registered sale deeds, which is illegal, arbitrary, and contrary to law. 4. Considering the above, this Court is not inclined to go into the merits of the matter. Accordingly, the Writ Petition is disposed of by directing the petitioner to submit an online application before the competent authorities for deletion of the subject property from the prohibitory list issued under Section 22-A of the Registration Act, 1908, within a period of two (02) weeks from the date of receipt of a copy of this order. Upon such application being filed, the respondent authorities shall consider the same and pass appropriate orders in accordance with law, after obtaining necessary reports from the concerned authorities, within a period of three (03) months thereafter.
