Present appeal has been filed by the appellants, namely, Dushasan, Latoori Singh, Amar Singh and Badri arises from the judgement and order dated 03.12.1984 passed by the III Additional Sessions Judge, Etah in S.T. No.355 of 1982, (State versus Dushasan and two others) and S.T. No.438 of 1982, (State versus Badri) whereby the appellants have been convicted and sentenced for life imprisonment for the offence under Sections 302 IPC read with 34 IPC. 3. By earlier order dated 15.05.2018, the appeal filed by appellant no.1-Dushasan, appellant no.2-Latoori Singh and appellant no.4- Badri was declared abated. 4. At present, the appeal survives only on behalf of appellant no.3- Amar Singh. 5. Today, Sri Surendra Singh, learned AGA has placed on record a report dated 05.07.2025 received by him from the Sub Inspector Abdul Jabbar, Police Station Kotwali Dehat, District Etah forwarded by the Officer In-Charge Police Station Kotwali Dehat, District Etah on 05.07.2025 amongst other stating that the appellant no.3-Amar Singh had died on 02.11.2023. Copy of the said report has been marked as 'X' and retained on record. 5. In view of above, the present appeal is declared abated and consign to record.
