This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a Writ, order or direction more particularly one in the nature writ of MANDAMUS, to declare the inaction of the respondent No.3 in not taken any enquiry by registering the complaint given by the Petitioner on 28.10.2025 against the Respondent Nos.4 to 9, as illegal, arbitrary, unconstitutional against the procedure prescribed under law, consequently direct the 3rd Respondent to register the FIR, enquire and take action against the respondent Nos.4 to 9, in accordance with law, and pass..…”

Heard Sri G.Krupachand, learned Counsel for the Petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for the Official Respondents. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that the Petitioner has filed a complaint contending that the Respondent No.4, who is the husband of the Petitioner herein and the Respondent No.7 are living together as husband and wife, while the marriage of the Petitioner and the Respondent No.4 is still subsisting. After receiving the complaint from the Petitioner, the Respondent No.3 has issued a receipt to the Petitioner vide Reception No.669 of 2025 dated 28.10.2025 and entered the contents into the General Diary. Learned Assistant Government Pleader for Home would further submit that the Respondent No.3 has sent a requisition to the Additional Public Prosecutor, V Additional Judicial First Class

Magistrate Court, Rajamahendravaram, for legal opinion. He would further submit that on 08.11.2025, the Respondent No.3 received legal opinion from the Additional Public Prosecutor as “if the marriage between the husband of defacto complainant and Ravali Gore was performed as like the marriage performed between the defacto complainant and her husband, it attracts the offence of bigamy U/s.82(1) of BNS, otherwise it does not attract any offence”. Therefore, the Respondent-Police have asked the complainant to produce such type of documents and proofs, but she failed to produce the same. Therefore, the petition was closed by the Respondents No.3. 4. Recording the above said submissions, this Writ Petition is disposed of. However, the Petitioner is at liberty to work out her remedies before the appropriate forum according to law. There shall be no order as to costs.
