This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide Case No. 1841 of 2015, arising out of Case Crime No. 283 of 2014, under Sections 379, 328, 411 IPC, Police Station Wazirganj, District Budaun pending in the Court of Addl. Civil Judge (JD)/J.M. Court No.5, Budaun, expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. It is submitted by the learned counsel for the applicant that the applicant before this Court is accused in the aforesaid case. He is languishing in jail in some other matter but surprisingly there are several order-sheets which reveal that non-bailable warrant has been issued against the present applicant for want of his appearance before the court but he was not summoned by the Court concerned so far and the case is pending unnecessarily. 4. In these circumstances, the applicant is directed to apprise the trial court with the fact that in which jail he is detained at present and the trial court is directed to summon the accused / applicant from the said jail within one month from the next date fixed in the matter and if the accused / applicant appears before the Court concerned, all possible endeavours shall be made by it to expedite the trial of the case and conclude it expeditiously without granting any unnecessary adjournment to either of the parties, as the case is pending since 2015, which falls within the category of 'critically old cases'. 5. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc. are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 6.
