JUSTICE MA CHOWDHARY, JUDGE ORDER 02.01.2025 Petitioner through the medium of this petition in terms of Article 227 of the Constitution of India seeks a direction to the Court of learned Sub Judge Mobile Magistrate, Baramulla (trial court) to proceed with and decide the Suit File No. 65/Civil, instituted on 07.06.2006 titled as “Khaliq Ganie through LRs versus State of Jammu & Kashmir & Others”, pending before the trial court expeditiously within a time frame, as the matter is eighteen years old and the petitioner as plaintiff is second generation. Learned counsel for the petitioner submits that the petitioner would be satisfied in case a direction is passed to the trial court for expeditious disposal of the suit as the case is pending disposal in ex- parte proceedings. His statement is taken on record. For the reasons assigned in the petition and those urged at the bar, this petition is disposed of at this stage with a direction to the trial court to make an endeavour for expeditious disposal of the case preferably within a period of next three months.
