HARI BABU MAGULURI SC For SERP The Court made the following: :: ORDER :: The above contempt case has been filed complaining of the violation of the order dated 17.10.2024 passed in W.P.No.23381 of 2024. 2. The petitioners, eight in number, filed the aforementioned writ petition, complaining that the Project Director, DRDA, Kakinada District; the Area Coordinator, DRDA, SERP, Jaggampeta; the Assistant Project Manager, Velugu, DRDA, Jaggampeta Mandal and the Community Coordinator, Velugu, DRDA, Jaggampeta Mandal, are interfering with the discharge of their duties as Village Organization Assistants (VOAs) of their respective societies. 3. The said writ petition was disposed of on 17.10.2024, directing the aforementioned respondents not to interfere with the petitioners’ discharge of duties as VOAs of their respective societies in Jaggampet Mandal, East Godavari. 4. In the affidavit filed in support of the contempt case, it was pleaded that the respondent authorities are interfering with the petitioners’ discharge of duties as VOAs. 5. A counter-affidavit has been filed by respondent No.4. Along with the counter-affidavit, resolutions passed by the respective societies have been annexed. A perusal of the resolutions would indicate that by resolution dated 21.08.2024, one Smt. B. Sandhya was elected as new VOA in the place of 1st petitioner; by resolution dated 22.08.2024, one Smt. Adapa Sai Lakshmi was elected as new VOA in the place of 2nd petitioner; by resolution dated 04.09.2024, one Smt. B. Chittemma was elected as new VOA in the place of 3rd petitioner; by resolution dated 22.08.2024 one Smt. K. Surya Bhavani was elected as newVOA in the place of 4th petitioner; by resolution dated 10.09.2024 one Smt. Y. Nagalakshmi, was elected as new VOA in the place of 5th petitioner; by resolution dated 10.09.2024, one Smt. Kondepudi Lakshmi was elected new VOA in the place of 6th petitioner; by resolution dated 24.11.2024, one Smt. Ungarala Durga Chandra Jyothi was elected as new VOA in the place of 7th petitioner and by resolution dated 10.09.2024, one Smt. Naramala Durga Devi was elected as new VOA in the place of 8th petitioner. 6. No rejoinder has been filed by the petitioner to the counter-affidavit filed by respondent No.4. 7. Thus, as seen from the resolutions annexed with the counter-affidavit, the petitioners were replaced with the new incumbents as VOAs. Thus, the contention of the petitioners that the respondents are interfering with their discharge of duties is misplaced. Hence, this Court does not find any violation of the order 17.10.2024 passed in W.P.No.23381 of 2024 and the contempt case is liable to be dismissed. 8. Given the facts and circumstances of the case, the Contempt Case is dismissed. No order as to costs.
